The EB-5 Immigrant Investor Visa is designed for individuals who make a qualifying investment in a new commercial enterprise in the United States. Under current EB-5 requirements, the minimum investment is generally $800,000 for a qualifying targeted employment area or infrastructure project, or $1,050,000 for a standard investment outside those qualifying areas.

The EB-5 investor does not always have to be physically present in the United States to apply for an EB-5 visa. In many cases, an investor may apply from their home country and then enter the United States as a permanent resident after approval and completion of consular processing.
After approval, an EB-5 investor may receive conditional permanent resident status. The initial Green Card is generally valid for two years. Before the conditional status expires, the investor must file a petition to remove conditions, usually within the 90-day period before the two-year Green Card expires.
